1. Acceptance of Terms

By accessing or using Level Up Classroom or OSSLTPrep ("the Service"), operated by Level Up Classroom Inc., you agree to be bound by these Terms of Use. If you do not agree to these terms, you may not use the Service. These terms apply to all users, including teachers, students, administrators, and school board personnel.

2. Description of Service

Level Up Classroom is a gamified classroom management and gradebook platform designed for educators. The Service includes features for grade tracking, attendance management, student engagement (gamification), report generation, timetable scheduling, and AI-assisted content creation. OSSLTPrep is an Ontario Secondary School Literacy Test practice platform integrated into Level Up Classroom. Both platforms are operated by Level Up Classroom Inc.

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials
You must provide accurate and complete information when creating an account
You are responsible for all activities that occur under your account
You must notify us immediately of any unauthorized use of your account
Teachers are responsible for the appropriate use of student data entered into the system and for obtaining any required parental consent

4. Acceptable Use

You agree NOT to:

Use the Service for any unlawful purpose or in violation of any applicable laws
Attempt to gain unauthorized access to any part of the Service or its systems
Interfere with or disrupt the Service or servers/networks connected to the Service
Upload or transmit viruses, malware, or other malicious code
Collect or harvest user information without consent
Impersonate any person or entity or misrepresent your affiliation
Use the Service to harass, abuse, or harm others
Exploit bugs, vulnerabilities, or errors in the Service

Account Suspension & Termination

We reserve the right to suspend or terminate accounts that violate these terms, exploit bugs or vulnerabilities, or engage in abusive behavior. All account activity may be logged for security purposes. Serious violations may be reported to appropriate authorities.

5. Intellectual Property

The Service, including its design, features, and content (excluding user-generated content), is owned by Level Up Classroom Inc. and protected by intellectual property laws. You retain ownership of the educational content you create and upload to the Service, including grades, comments, lesson materials, and student work.

6. AI-Generated Content

AI features (report comments, rubrics, lesson plans, essay feedback) are provided as suggestions only. Teachers are responsible for reviewing, editing, and approving all AI-generated content before use. We do not guarantee the accuracy, appropriateness, or completeness of AI-generated content. OSSLT essay grading scores are approximate and intended for practice purposes only — they do not represent official EQAO scores and should not be used as formal assessments.

7. OSSLT Practice Content

OSSLT practice tests and Literacy Dojo exercises are provided for educational practice only. Scores generated by the platform (both auto-graded and AI-graded) are approximate and are not official EQAO results. Practice test content is not affiliated with or endorsed by EQAO. OSSLT practice features are not connected to the Level Up Classroom gradebook — all practice data is separate from class grades and academic records.

8. Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

To the maximum extent permitted by law, Level Up Classroom Inc. shall not be liable for:

Any indirect, incidental, special, consequential, or punitive damages
Loss of data, profits, or business opportunities
Service interruptions or technical failures
Actions of third parties or other users
Inaccuracies in AI-generated content or practice test scoring
Decisions made based on information in the Service

9. Indemnification

You agree to indemnify and hold harmless Level Up Classroom Inc., its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these terms.

10. Data Retention & Deletion

Active accounts: All data is retained for the duration of your account.
Deleted content: When you delete classes, students, or assessments, items are moved to a recoverable deletion history to allow restoration. These records persist until you request full purge.
Archived classes: Retained based on subscription plan, then automatically deleted by a nightly scheduled process.
Account cancellation: Upon account deletion or subscription cancellation, all personal data and educational records are permanently deleted. Contact reece@levelupclassroom.com.
Deletion requests: You may request immediate deletion of your account and all associated data at any time via email to reece@levelupclassroom.com.

11. Changes to Terms

We reserve the right to modify these terms at any time. Continued use of the Service after changes constitutes acceptance of the modified terms. We will notify users of significant changes via email or in-app notification with at least 30 days notice for material changes.

12. Governing Law

These terms are governed by the laws of the Province of Ontario, Canada. Any disputes shall be resolved in the courts of Ontario, Canada.
